that individual may die and maybe leave behind something another person can learn from - the social contract of "hey you can look at this and learn from it" is only valid because there has been no way to automate that so far, there were implicit constraints on it from the start

If a painter studies thousands of works to develop their own style, we call it education. If a musician learns every chord progression ever written and creates something new, we call it artistry. That is: based on how people talk about the tech 1, people assume (or are led to believe) that training an LLM is like someone studying earlier works and learning from them. It is, in fact, _utterly unlike that_.
Since these _are_ entirely different processes, it's complely reasonable that different rules apply.
