I'm not sure that the smaller number would have helped at SCOTUS - strikes me that it would have hurt, if they thought there was less impact - but I'm not sure ANY number would have convinced SCOTUS. And, still, that's not the point. Duty of candor is a rule, and the SG doesn't get to violate it.
