This follows the replacement of acting U.S. attorney Erik Siebert, who refused to indict Comey and New York Attorney General Letitia James. Former Trump personal lawyer Lindsey Halligan, newly sworn in as interim U.S. attorney, may have no such qualms. But according to LawFare Media's Benjamin Wittes and Anna Bower, it might not be as simple as all that. The two explain all the challenges for Halligan, from timing (the key statute of limitations runs out in six days) to the inherent weakness of the case and the thorny issue of what to charge Comey with. "This isn’t normally a problem prosecutors face, as they start with a crime, then figure out whodunnit, rather than starting with a person and only then deciding whathedun."
