"Because there is no legitimate war between the two sides, killing any of the men in the boats 'amounts to murder,' said Todd Huntley, a former military lawyer who advised Special Operations forces for seven years at the height of the U.S. counterterrorism campaign."

"Even if the U.S. were at war with the traffickers, an order to kill all the boat’s occupants if they were no longer able to fight 'would in essence be an order to show no quarter, which would be a war crime,' said Huntley, now director of the national security law program at Georgetown Law."

"Hiding the evidence from the American public: Later in the day, President Donald Trump released a redacted 29-second surveillance drone video showing the attack. The video does not include any footage of the subsequent strike on the survivors.

And to Congress, Administration explanation to Congress seems to be a bold-face falsehood: claiming double-tap strike was to clear debris, not to kill survivors."

"That explanation has prompted frustration among some members of Congress who say they believe the Pentagon was deceptive.

The Pentagon has not fulfilled a bipartisan request from lawmakers to see unedited footage."

"To put a finer point on this whole thing: 'Two people with direct knowledge of the operation' — presumably uniformed military leaders — are accusing the U.S. Secretary of Defense of personally ordering specific war crimes. That's a historic accusation."

"Heinz-Wilhelm Eck might have something to say about this one.

To be explicit, we executed a German U-Boat commander who said he had to sink lifesaving gear / 'inadvertently' kill survivors because it might give away his position, thereby potentially resulting in the loss of his submarine.

We executed multiple members of that crew."

"Ordering no quarter, as Hegseth effectively did, isn't a newfangled modern war crime. It was understood as a crime as far back as the Revolutionary War. Washington threatened to do reprisals over it. The bad guy in 'The Patriot' is (very loosely) based off a British officer who was notorious for it."

"Hegseth's not the only war criminal here. 'The [USSOCOM] commander overseeing the operation from Fort Bragg in North Carolina, Adm. Frank M. 'Mitch' Bradley, told people on the secure conference call that the survivors were still legitimate targets... He ordered the second strike.' "

"Bradley, more than Hegseth, just shot straight to the top of the list of people most likely to be prosecuted. Not because a future Dem administration will necessarily have strong political will for prosecutions. Because the military itself will be chomping at the bit to nail his ass to the wall."

Don't quote me but as I recall from the BTB episodes* on Hegseth, he seemed to think we lost wars because we wouldn't do war crimes. That hands were tied and thus winning was impossible.

Which is probably the position of a lot of the folks doing war crimes at this moment. A vague belief that if only there weren't pesky rules, they wouldn't be losers.

*Episodes were from August 4 & 7 2025 for anyone curious. They discuss his 2020 book.

If we really thought the men on the boat were narcos, the survivors would have been rescued for questioning.

Mother Bones reshared this.

in reply to Mother Bones

Should go without saying, that U-boat commander had a lot better tactical justification than "they mighta gotten rescued," which is exactly what you are supposed to do with vanquished enemies at sea.

Mother Bones reshared this.

in reply to Mother Bones

Congress has not declared war, so there can be no "war crimes".

Let's demand to know everyone involved in this conspiracy to commit murder, from who gave the illegal order to who pulled the trigger.

Prosecute them all for conspiracy to commit murder.

@maddad Yeah I just posted the link behind a CW so that people would not be subjected in their timelines to the thumbnail image of (distant) people in a boat being murdered, but if someone wanted to click through to see the link or the headline or photos they can.

I find using Brave over Linux with the avoid paywall filter enabled I can open most pay news sites. Sometimes a bit of juggling is needed, but normally it usually works.

@FlashMobOfOne I don't have illusions either, but I sure have hope, and only with publicizing their crimes is there any hope that public approbation can even begin to drive justice.
